Criminal Record Expungement

A person charged with a misdemeanor or convicted of a felony, but not required to spend time in jail is able to file motion for criminal record expungement. It is a motion to dismiss a criminal conviction. The expunged criminal record does not remove the arrest record. An arrest may only be removed upon a motion of innocence. Expungement of arrest records is beneficial for people applying for jobs, because they will have a clear criminal record if their criminal history is checked.

Expungement may be granted for convictions including drug possession, drug trafficking, marijuana cultivation, weapons charges, robbery, white collar crimes, gang violence, assault and battery, sex assault, homicide, and rape. This is only true if no prison time has been served or ordered.

Certificate of Rehabilitation

A certificate of rehabilitation declares a person convicted of a felony or qualified misdemeanor and who has served prison time has been rehabilitated. The certificate is an automatic application for pardon by the governor. To qualify a person must have lived in California for 3 to 5 years prior to applying for a certificate of rehabilitation and a reasonable amount of time must have passed since release from prison, usually seven years. However one is unlikely to receive a certificate until 10 years has passed, all probation and parole requirements have been met, and no violations to either were incurred.

Early Termination of Probation

You may be eligible for early termination of probation if you have met all of the requirements of your probation. Probation requirements may include completing jail time, alcohol or drug programs, anger management, restitution, and fines. Early termination is unlikely to be granted if probation is violated.
